Ardoino’s deposition is scheduled to take place this week.
The class action lawsuit accuses Bitfinex and Tether of fraud, money laundering, and market manipulation.
Both exchanges deny the charges in a statement on June 30, 2023.
Ardoino was given too little time to prepare, however, and the court rejects his request to have the deposition delayed until October.
The case will now move forward with arguments on several topics, including the adequacy of Tether’s reserves and the sufficiency of its reserves.
This is the third update on the status of the case.
Previously, the court had ordered the deposition to go forward immediately on all of the asserted topics but granted a stay on the remaining issues until September 7.
